BLACKSTONE CONSERVATION COMMISSION MINUTES OF MEETING JANUARY 18, 2012 James Plasse, Chairman, called the meeting to order at 7:00 p.m. in the Senior Center in the Town Hall. Present Were: James Plasse James Pitler Maggie Plasse Lisa Brita Tamara Heiselmeyer Absent Was: Beverly Wilson Mr. Plasse read aloud a Cease and Desist Letter sent to Allen Rivers for his property at 17 Shore Drive. Mr. Rivers and Rick Gentes were present at the meeting. Mr. Plasse stated that the foundation constructed was different from the one on the plan associated with the existing Order of Conditions on file. He also stated that the silt barrier should be placed at fifty feet. Mr. Rivers said that he submitted a new plan with new setbacks to the Building Inspector. He thought that the Building Inspector would submit the new plan to the Conservation Commission. Mrs. Brita said that when she inspected all she saw was a ditch of dirt and the silt barriers. She didn’t measure anything. Mr. Rivers said that the silt barriers are in the correct place according to the plan and the Order or Conditions. Mr. Plasse said that the Conservation Commission should have been notified when the silt barriers were in place. Mr. Rivers said that was his fault. Mr. Plasse said that they need to install a split rail fence. Mr. Rivers said that he is aware of that. Mr. Pitler said that we need to consider the history of the house that will be moved to this property and take the best course of action for everyone. He suggests having Mr. Rivers file a new Notice of Intent. Abutters should be notified. This process should be kept as open as possible. Mr. Rivers said that he would like to rectify the situation, but he shouldn’t be penalized. Mr. Gentes said that placing the silt fence at 33 feet was extremely conservative according to the Order of Conditions. Mr. Plasse said that state regulations are 50 feet. Ms. Plasse reiterated that Mr. Rivers did not notify the Commission of the new plan or the start of construction. Mr. Rivers again said that he thought the Building Inspector had taken care of that. Conservation Commission, Minutes of Meeting, January 18, 2012, Ms. Plasse made a motion to issue Mr. Rivers an Enforcement Order and to require that he submit a new Notice of Intent with up to date drawings. Mr. Pitler seconded the motion. The motion was passed by Unanimous Vote. Mr. Pitler stressed that the contractor should not be held liable. Mr. Plasse said that there is no need to tear down the foundation they just installed. All the members agreed. Mr. Plasse informed Mr. Rivers that the Commission’s next meeting is Tuesday, February 21st at 7:00. He told Mr. Rivers that if he can get his Notice of Intent in to us early enough, we can have Natural Resource Services do a site inspection before the meeting.
